    Mediation Information and Assessment Meeting (MIAMs)

    The Mediation Information and Assessment Meeting (MIAM) serves as the initial stage of the mediation process, during which you will have an opportunity to converse with a mediator about your circumstances and assess whether mediation could be beneficial for you and your family. Only you and the mediator will be at this initial meeting. 

    The duration of MIAMs typically ranges from 45 minutes to one hour, depending upon the number of issues that need to be addressed. While some individuals may only require mediation to resolve a solitary issue, others may have far more intricate child and financial arrangements to resolve.

    MIAMs may be conducted either in person or online. Online MIAM appointments can typically be arranged more swiftly than in-person meetings, as it may require a week or two to secure appropriate office accommodation for the latter. This is the primary rationale for individuals frequently opting for online MIAMs. We can generally provide privately paying clients with an appointment within a few days, and in some cases, even on the same day. However, Legal Aid-funded clients may also avail themselves of this service, albeit the Legal Aid assessment procedure must be concluded before the MIAM, which takes approximately 10 working days.

    Financial Process

    Financial mediation entails the engagement of a mediator who provides legal information and facilitates communication, thereby fostering a positive environment conducive to finding a desirable outcome between the participants. Through impartially addressing these matters, both participants can swiftly arrive at a mutually acceptable resolution. In family mediation, it is important to note that a resolution/agreed proposal does not become legally binding until a court order ratifies it.

    After reaching a financial agreement, we deliver an Open Financial Statement (OFS) to document the financial assets, and a Memorandum of Understanding (MOU), which outlines the specific terms of the agreed-upon proposals.

    Child Arrangement Process

    Mediation affords parents and children the opportunity to express their thoughts and opinions. The perspectives of both parents, and in some cases that of the child, are given due consideration. By prioritising the child’s welfare, the mediation process endeavours to facilitate the achievement of mutually acceptable agreements between parents.

    How can I apply for a court order for finances and child arrangements?

    Divorce Form E is a form utilised within the legal system of England and Wales, in relation to the financial aspects of separation or divorce. Family mediation typically does not use it. The Form C100 is utilised for the purpose of settling child arrangements.
