What it’s all about

Definition of Family Mediation

In cases where relationships break down, engaging in legal battles between separating or divorcing couples can be a time-consuming, expensive, and emotionally draining process. Family mediation provides a constructive alternative by allowing both participants to collaborate and develop mutually beneficial proposals.

This collaborative approach aims to reduce conflict and promote positive outcomes for all participants involved, including the well-being of the children. Furthermore, family mediation sessions provide an opportunity for individuals to reach non-confrontational and constructive agreements concerning children, property, and finances, even after separation.

    Benefits

    Advantages of Family Mediation

Facilitates communication between participants through the involvement of family mediators.

Supports parents in finding mutually agreeable solutions and reducing conflict.

Offers a less stressful alternative to court proceedings.

Contributes to the welfare of the children involved.

Provides a more cost-effective solution compared to court proceedings.

Mediation Information and Assessment Meeting (MIAMs)

The Mediation Information and Assessment Meeting (MIAM) serves as the initial stage of the mediation process. It allows individuals to discuss their personal circumstances with a mediator and evaluate whether mediation could be beneficial for themselves and their families. MIAMs can be conducted either in-person or online, depending on individual preferences.

Additionally, clients eligible for Legal Aid can also avail themselves of this service. However, before attending the MIAM, it is necessary to undergo the Legal Aid assessment procedure, which typically takes around 10 working days to complete.

    Financial Process

Qualified and accredited mediators conduct family mediation sessions related to financial matters. It is important to note that resolutions reached through family mediation are not legally binding until a court order ratifies them.

Once a financial agreement is reached, an Open Financial Statement (OFS) is prepared to document the financial assets. Simultaneously, the Memorandum of Understanding (MOU) outlines the specific terms of the agreed-upon proposals.

    Child Arrangement Process

Family mediation offers a secure and supportive environment for parents and children to express their thoughts and opinions regarding the situation at hand. The perspectives of both parents and in some cases, the child, are taken into consideration, allowing for thoughtful deliberation.

By prioritising the welfare and voice of the child in the dispute, the mediation process aims to facilitate mutually acceptable agreements between parents.

I did it and now would like to recommend it. Dealt with Stuart, who was the man at the exact time. His approach and a great way of directing me with presenting my issues were surprisingly way easier than I projected the obstacle in my mind. Highly recommend it as this removes my blockage. A wealth of experience. Many thanks Stuart

Lesley was very professional throughout and ensured we were both comfortable to start mediation together. Although it was a tough experience and brought up some baggage I feel it was very useful overall to reflect on our approach to parenting in the long term rather than focussing on the current uncomfortable situation. We've already started putting in place some of what we have discussed which I feel is already improving both our relationship with our child and each other.
